1. Acceptance of Terms
Welcome to the website of Goldcoast Ballroom, Inc. ("Goldcoast Ballroom," "we," "us," or "our"), located at 1415 Lyons Road, Coconut Creek, Florida 33063. These Terms of Use ("Terms") govern your access to and use of www.goldcoastballroom.com (the "Website"), including all content, features, and functionality offered on or through it.
By accessing or using this Website, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Disclaimer, each of which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Website immediately.
These Terms apply to casual visitors, registered users, class/lesson inquiries, and anyone submitting information through any form on this Website.
2. Eligibility
This Website is intended for users who are at least 18 years of age, or who are accessing it under the supervision of a parent or legal guardian. If you are under 18, you may only use this Website, and register for classes, private lessons, or events, with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
3. Use of the Website
You agree to use this Website only for lawful purposes and in accordance with these Terms. You agree not to:
Use the Website in any way that violates any applicable federal, state, local, or international law or regulation
Attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website
Use any automated means (bots, scrapers, spiders) to access the Website for any purpose without our express written consent
Transmit any advertising or promotional material, including "junk mail," "spam," or any solicitation, through the contact forms, e-mail addresses, or any other feature of this Website (see Section 4)
Impersonate or attempt to impersonate Goldcoast Ballroom, an employee, another user, or any other person or entity
Upload or transmit any material that is unlawful, harassing, defamatory, obscene, or otherwise objectionable
4. No Solicitation Policy
This Website, including its contact forms, is intended for our patrons, clients, prospective clients, and guests only. We do not accept, and expressly opt out of, any sales or business solicitation e-mails or inquiries submitted through this Website, its contact forms, or otherwise. Any party found to be in violation of this policy may be reported to appropriate authorities and may be permanently barred from further contact.
5. Assumption of Risk & Release (Physical Activity)
Dancing, and related physical activity offered by Goldcoast Ballroom (including but not limited to group classes, private lessons, social dances, showcases, competitions, and events), carries inherent risks of physical injury. These risks include, without limitation, falls, collisions with other participants, muscle strain, and other injuries that can occur during dance instruction, practice, or social dancing, whether or not caused by the negligence of Goldcoast Ballroom, its instructors, employees, or other participants.
By participating in any in-person activity at Goldcoast Ballroom, you voluntarily assume all risks associated with such participation, to the fullest extent permitted by Florida law.
This Website's Terms of Use do not, by themselves, constitute a legally sufficient waiver of liability for in-person physical injury. Participants in classes, private lessons, and events will be required to review and sign a separate, dedicated Liability Waiver and Release of Claims at the time of registration or check-in, which will govern their in-person participation. (See attached companion document: "Liability Waiver & Release — In-Person Participation," provided separately for your registration/check-in process.)
6. Alcohol & Food Service
Goldcoast Ballroom sells and serves alcoholic beverages on-site under its own license. In addition, at certain private rental events, an outside caterer, bar service, or event renter may provide their own alcoholic beverages, and/or guests may bring alcoholic beverages onto the premises in connection with a private event. Where alcohol is served, provided, or brought onto the premises:
Guests must be 21 years of age or older to consume alcoholic beverages, and valid identification may be required
Goldcoast Ballroom, and/or the applicable licensed service provider, reserves the right to refuse service to any individual
Guests are solely responsible for their own consumption and conduct, and agree not to operate a motor vehicle while impaired
Outside/BYOB Alcohol: Goldcoast Ballroom does not sanction guests or renters bringing their own alcohol onto the premises, and reserves the right to prohibit or remove any such alcohol. Where outside alcohol is nonetheless brought onto the premises by a renter, their guests, or their vendors, that renter assumes full and sole responsibility and liability for all such alcohol, including its service, consumption, and any resulting injury, damage, or claim (including any claim arising under Florida's dram shop or related statutes). Goldcoast Ballroom is not liable for alcohol it did not itself sell or serve. Renters agree to indemnify Goldcoast Ballroom for any such claims, as further set forth in the applicable Rental Agreement.
Where food is served, Goldcoast Ballroom does not guarantee the absence of allergens; guests with food allergies or dietary restrictions should inquire directly with venue staff or the event's catering provider before consuming any food on the premises
7. Rentals & Private Events
Parties renting the facility for weddings, private parties, corporate functions, or other events are subject to a separate Rental Agreement, which will govern the specific terms, deposits, cancellation policies, and liability allocation for that event. These Terms of Use apply to the Website itself and do not replace or supersede any signed Rental Agreement.
8. Photography, Video, and Publicity Release
Goldcoast Ballroom regularly photographs and records video at its social dances, classes, showcases, competitions, and events, for use in its photo and video galleries, marketing materials, social media, and website.
By attending any event, class, or activity at Goldcoast Ballroom, you acknowledge and agree that you may be photographed or recorded, and that Goldcoast Ballroom may use your image, likeness, and voice in such photographs or recordings for promotional and marketing purposes, without additional compensation to you. If you do not wish to be photographed or recorded, please notify venue staff in advance so reasonable accommodation can be considered; however, Goldcoast Ballroom cannot guarantee exclusion from wide-shot event photography or video at public events.
9. User-Submitted Content
If you submit any comments, suggestions, testimonials, or other content to this Website (including through the Suggestion Box or Contact form), you grant Goldcoast Ballroom a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with the Website and our promotional materials. You represent that any content you submit is your own original work, or that you have the right to submit it, and that it does not violate the rights of any third party.
10. Intellectual Property
All content on this Website — including text, graphics, logos, photographs, videos, and the compilation thereof — is the property of Goldcoast Ballroom, Inc. or its licensors, and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent, except for personal, non-commercial use.
11. Third-Party Links
This Website may contain links to third-party websites (including social media platforms, resource pages, and other external sites) that are not owned or controlled by Goldcoast Ballroom. We are not responsible for the content, privacy policies, or practices of any third-party websites. Your use of any linked third-party website is at your own risk and subject to that website's own terms and policies.
12. Disclaimer of Warranties; Limitation of Liability
Please see our separate Disclaimer, which is incorporated into these Terms by reference and governs warranties, representations, and limitations of liability related to your use of this Website and participation in Goldcoast Ballroom activities.
13. Indemnification
You agree to indemnify, defend, and hold harmless Goldcoast Ballroom, Inc., its owners, officers, employees, instructors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Website, your violation of these Terms, or your participation in any Goldcoast Ballroom activity, event, or rental.
14. Changes to These Terms
Goldcoast Ballroom, Inc. reserves the right to amend or update these Terms at any time, at our sole discretion. The date of the most recent revision will be posted at the top of this page. Your continued use of the Website following any change constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
15. Governing Law; Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
